This Legal section governs the use of this website and all services provided by Ductworx Furnace Cleaning Ltd. (“Ductworx,” “Company,” “we,” “us,” or “our”) to any individual or entity (“Customer,” “you,” or “your”). This applies to all residential and commercial services, whether booked online, by phone, email, text message, or in person.

By accessing this website, requesting information, booking services, approving quotes, communicating with us, or permitting services to proceed, you acknowledge, accept, and agree to the terms, conditions, disclosures, and limitations set out below.

1. Nature of Services

Ductworx provides professional HVAC-related maintenance services, including but not limited to:

  • Furnace and duct cleaning
  • HVAC system cleaning
  • Dryer vent cleaning
  • Related inspection and maintenance services

All services are maintenance and cleanliness services only. Services are limited strictly to the scope described in the estimate, work order, booking confirmation, or invoice.

2. No Guarantee of Results

Due to the nature of HVAC systems and environmental variables, Ductworx does not guarantee:

  • Complete removal of dust, debris, allergens, mold spores, bacteria, or contaminants
  • Improvements to indoor air quality, airflow, system efficiency, or health outcomes
  • Resolution of odors, respiratory symptoms, or mechanical issues

Results vary depending on system age, condition, design, prior maintenance, renovations, occupancy, pets, smoking, construction debris, and environmental factors beyond our control.

3. Health & Medical Disclaimer

Ductworx does not provide medical, environmental health, or indoor air quality certification services.

No statements, representations, or recommendations made by Ductworx or its technicians constitute medical advice or health guarantees. Customers with health concerns must consult qualified medical or environmental professionals.

4. Hazardous Materials Exclusion

Ductworx does not perform mold remediation, asbestos abatement, vermiculite removal, or hazardous materials handling.

If hazardous or suspected hazardous materials are identified, Ductworx reserves the right to immediately suspend or terminate service. All charges incurred up to that point remain payable.

5. Technician Qualifications & Authority

Ductworx technicians are trained and operate in accordance with internal standards and industry best practices.

  • Technicians are not authorized to:
  • Modify pricing or fees
  • Waive charges
  • Provide warranties or guarantees
  • Alter legal terms
  • Enter into binding agreements on behalf of Ductworx

Any technician observations or opinions are informational only and do not constitute professional engineering, legal, or medical advice.

6. Customer Responsibilities

The Customer is responsible for:

  • Providing safe, lawful, and unobstructed access to all service areas
  • Ensuring utilities (power, heat, ventilation) are operational
  • Disclosing known system defects, hazards, or access limitations
  • Securing pets and occupants
  • Protecting personal property and valuables

Delays, additional work, or inability to complete service due to restricted access, unsafe conditions, or undisclosed issues are the Customer’s responsibility and may result in additional charges or service refusal.

7. Pre-Existing Conditions

HVAC systems may contain pre-existing or concealed defects, including deteriorated ductwork, corrosion, improper installation, loose connections, or fragile components.

Ductworx is not responsible for damage caused by normal wear and tear, system age, improper installation, prior modifications, or latent defects. Pre-existing conditions may be documented.

8. Documentation, Recording & Evidence Collection

To ensure quality assurance, transparency, billing accuracy, and dispute resolution, Ductworx may collect Documentation, including:

  • Audio recordings of inbound and outbound telephone calls and electronic communications
  • Photographs and video of HVAC systems, ductwork, vents, service areas, pre-existing conditions, contamination levels, and completed work

Documentation may be used for:

  • Verification of services performed
  • Justification of additional work or charges
  • Dispute resolution, collections, insurance, or legal proceedings
  • Internal training and quality control
  • Documentation is not used for marketing without separate express consent.

Refusal to permit reasonable documentation may result in refusal, limitation, or termination of service, and Ductworx shall not be responsible for disputes arising from lack of documentation.

9. Fees, Charges & Pricing Structure

Pricing is based on standard systems and disclosed information at booking. The following charges may apply:

  • Fuel & Operating Fee – to cover transportation, equipment operation, maintenance, and logistics
  • Environmental & Disposal Fee – to cover waste handling, filter disposal, debris containment, and regulatory compliance
  • Credit Card Processing Fee – where permitted by law and properly disclosed

Additional Charges – for multiple furnaces, zones, rooftop units, oversized or commercial systems, restricted access, excessive contamination, construction debris, or undisclosed conditions

All applicable fees will be disclosed prior to or at the time of service where reasonably practicable.

10. Payment Terms

Payment is due immediately upon completion of service, unless otherwise agreed in writing.

Unpaid balances may be subject to administrative fees, interest (where permitted), collection activity, and legal action as allowed under Alberta law.

11. Chargebacks & Payment Disputes

The Customer agrees not to initiate improper chargebacks or payment reversals.

Ductworx reserves the right to submit documentation, recordings, photographs, and service records to financial institutions to dispute chargebacks. Improper chargebacks may result in additional administrative fees and collection action.

12. Cancellations, No-Shows & Booking Fees

A minimum of 24 hours’ notice is required to cancel or reschedule an appointment.

Late cancellations or no-shows may result in a cancellation fee. At Ductworx’s sole discretion, such fees may be waived, enforced, or applied as a credit toward a future booking. Credits are non-transferable and may expire.

Commercial bookings may require deposits and may be subject to stricter cancellation terms.

13. Right of Refusal & Service Termination

Ductworx reserves the unrestricted right to refuse, suspend, or terminate service without liability due to:

  • Unsafe, unsanitary, or hazardous conditions
  • Aggressive, abusive, or inappropriate behavior
  • Misrepresentation of system condition or scope
  • Suspected hazardous materials
  • Legal, safety, or compliance concerns

Charges for work performed and mobilization remain payable.

14. Insurance & Workplace Coverage

Ductworx maintains commercial general liability insurance and workers’ compensation (WCB) coverage as required by Alberta law.

Insurance coverage is maintained for the protection of Ductworx only and does not extend additional insured status to the Customer unless expressly agreed in writing.

15. Commercial Client Provisions

Commercial Customers represent that they have authority to approve services.

Ductworx is not responsible for disputes between landlords, tenants, property managers, or third parties. Commercial Customers agree to indemnify Ductworx against claims arising from site conditions, access restrictions, or third-party allegations not caused by Ductworx.

16. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Ductworx shall not be liable for indirect, incidental, special, or consequential damages
  • Liability, if any, is strictly limited to the amount paid for the specific service giving rise to the claim
  • Ductworx is not responsible for loss of income, profits, business interruption, or loss of use

Nothing herein limits liability where such limitation is prohibited by law.

17. No Warranties

All services are provided “as is” and “as available.”

Ductworx expressly disclaims all express or implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

18. Indemnification

The Customer agrees to indemnify and hold harmless Ductworx, its owners, directors, officers, employees, contractors, and agents from any claims, losses, damages, costs, or expenses arising from:

  • Customer negligence
  • Unsafe property conditions
  • Misrepresentation of system condition
  • Third-party claims

Except to the extent caused by Ductworx’s proven negligence or willful misconduct.

19. Force Majeure

Ductworx shall not be liable for delays or failure to perform services due to events beyond its reasonable control, including weather conditions, equipment failure, supply disruptions, utility outages, road closures, or acts of God.

20. Electronic Acceptance & Binding Agreement

Booking services online, approving quotes electronically, confirming appointments by email or text message, submitting online forms, paying invoices, or permitting services to proceed constitutes legal and binding acceptance of these terms.

Electronic records, confirmations, and communications are deemed valid and enforceable under applicable law.

21. Website Use & Limitation of Reliance

Website content is provided for general informational purposes only and does not constitute professional, legal, medical, or technical advice. Website information does not replace an on-site assessment.

22. Intellectual Property

All website content, logos, trademarks, text, images, graphics, and branding are the exclusive property of Ductworx Furnace Cleaning Ltd. and may not be copied, reproduced, distributed, or used without prior written permission.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

26. Entire Agreement

This Legal section, together with any estimates, work orders, invoices, or written agreements issued by Ductworx, constitutes the entire agreement between the parties and supersedes all prior discussions or representations.

This Corporate Privacy, Safety & Operational Policy (“Policy”) sets out the internal policies, service conditions, privacy practices, safety requirements, and operational standards of Ductworx Furnace Cleaning Ltd. (“Ductworx,” “Company,” “we,” “us,” or “our”).

This Policy applies to all customers, property owners, tenants, occupants, commercial clients, and authorized representatives (“Customer”).

This Policy operates in addition to, and in compliance with, all applicable federal, provincial (Alberta), and municipal laws. Nothing in this Policy limits or waives any non-waivable legal rights or obligations.

By accessing our website, requesting information, booking services, approving estimates, communicating with us, or permitting services to proceed, you acknowledge and agree to this Policy.

1. Purpose & Authority of This Policy

By booking services or permitting services to proceed, the Customer provides consent for all practices described in this Policy. Consent may be withdrawn subject to legal and contractual limits.

6. Documentation, Recording & Reporting

a) Call Recording

Inbound and outbound calls and electronic communications may be recorded for quality assurance, verification, billing confirmation, training, and dispute resolution.

b) Photographs & Video

We may document:

  • Furnaces, ductwork, vents, cold air returns
  • Access points and service areas
  • Pre-existing conditions or damage
  • Contamination levels
  • Completed work

c) System Testing

Airflow and system performance may be tested before and after service using professional instruments. Results may be included in service reports and delivered electronically (including via Jobber).

All documentation and testing results are informational only and do not constitute engineering certification or guarantees.

7. Adult Presence & Authorization

For residential services, an adult (18+) homeowner or authorized representative must be present at the start and completion of service and must have authority to:

  • Grant access
  • Approve scope changes
  • Authorize payment

If this condition is not met, Ductworx may delay, limit, or terminate service.

8. Children & Pet Safety

All children and animals must be secured away from service areas at all times.

Customers are responsible for maintaining a safe environment. Failure to do so may result in service suspension or termination.

9. Access & Work Area Requirements

Customers must ensure:

  • All vents, registers, cold air returns, and furnaces are accessible
  • Mechanical rooms are unlocked and clear
  • Furniture and belongings are removed from service areas
  • Restricted access may result in incomplete service or additional charges.

10. Entry Method & Hose Access

Ductworx uses professional equipment requiring hose access. The shortest, safest, and most efficient entry route will be selected at Ductworx’s discretion, which may include doors or basement windows.

11. Furnace Shutdown & Downtime

The furnace must be shut down during cleaning for safety and effectiveness.

Gas supply is not typically shut off unless required

Electrical power may be disconnected

Typical downtime is 2–3 hours per furnace

Additional time may be required for multiple systems or heavy contamination

Heating will be unavailable during this period.

12. System Condition & Post-Service Operation

Ductworx is not responsible for system failures, error codes, or malfunctions resulting from:

Pre-existing conditions

Age, wear, corrosion

Latent defects revealed during cleaning

Cleaning may expose existing issues that were present prior to service.

13. Property Wear & Pre-Existing Damage

Minor cosmetic wear resulting from reasonable access is not the responsibility of Ductworx. Customers must identify fragile or high-risk areas prior to service.

14. Utilities & Safety Authority

Ductworx may shut down HVAC systems, electrical power, or gas supply were reasonably necessary for safety. Issues revealed during shutdown or restart due to pre-existing defects are not the responsibility of Ductworx.

15. Parking, Noise & Third-Party Interference

Customers must provide reasonable parking access. Equipment may generate noise and vibration. Ductworx is not responsible for delays or disputes caused by third parties (landlords, tenants, property managers).

16. Payment Terms & Corporate Fee Policy

Payment is due before or immediately upon completion unless otherwise agreed in writing.

Cheques are not accepted.

Fees:

Ductworx may apply fuel, environmental/disposal, and payment processing fees were disclosed. Exact amounts are shown on estimates, work orders, or invoices, which govern.

17. Disclosure to Third Parties

Information may be disclosed to service providers, insurers, legal counsel, collection agencies, or authorities where required by law. Personal information is not sold.

18. Safeguards & Security Incidents

Reasonable safeguards are used to protect information. In the event of a privacy or security incident, appropriate mitigation and notification will occur as required by law.

19. Retention, Access & Correction

Information is retained only as long as necessary. Customers may request access or correction subject to legal exceptions.

20. Electronic Communications

Service-related communications may be sent as required. Promotional communications may be opted out of at any time.

21. Minors & Online Tracking

We do not knowingly collect information from individuals under 18. Cookies and analytics may be used; Do-Not-Track signals are not currently responded to.

22. Policy Hierarchy & Compliance
